摘要:
为优化政府安全监管职能,基于功能共振分析方法的特点,结合我国有关法律、法规、部门规章之规定,借鉴英国健康安全执行局对自身职能的定位,以原国家安全生产监督管理总局为例,识别、归纳其安全监管职能,对其进行耦合分析,并绘制职能网络图,找出薄弱环节,进而提出针对性的优化措施。结果表明:总局的职能共计8项,分别为立法立规、制订规划、执法、事故调查、应急救援、行政监察、科研推广、统计分析; 职能间的不合理共振会导致安全监管失效,其中影响最大的职能为制订规划,其次是统计分析和立法立规; 制订规划、立法立规、统计分析、执法、行政监察等5项职能有待优化。
Abstract:
In order to optimize the functions of governmental supervision on work safety in China,this paper investigated the supervision functions of State Administration of Work Safety based on national laws,regulations, and governmental documents according to the provisions of Health and Safety Executive,and adopted the Functional Resonance Analysis Method model to build functional network diagram for coupling analysis.The results show that there are eight functions of SAWS,including legislation,planning,law enforcement,accident investigation,emergency rescue,administrative supervision,promotion of scientific research and statistical analysis.Unreasonable resonance between functions could lead to poor safety supervision.The most important function is the “planning”,followed by the “statistical analysis” and “legislation and regulation” functions.Five functions should be optimized.
